Terms of Service — Aura Catch
1. General provisions
The owner of the Aura Catch website and application is Dariusz Szweda.
These Terms of Service define the rules for using the Aura Catch mobile application and web platform.
Using the Application means accepting these Terms.
2. Application functionality
Aura Catch enables users to monitor product prices across 32 markets and access offer and promotion information.
The Application is informational and supportive in nature.
The Controller is not the seller of products presented in the Application and does not participate in concluding sales contracts between the user and a store or marketplace platform.
3. Subscription rules and limits
3.1. A FREE plan user can track a product for 30 days from the moment it is added.
3.2. In the FREE plan, the price is updated once per day (every 24 hours), around the time when the product was added to the database.
3.3. After 30 days, tracking ends and historical product data is archived in accordance with the Privacy Policy.
3.4. In the FREE plan, up to 3 products can be added per 30-day cycle. Deleting a product does not free up a slot — a new slot becomes available 30 days after the product was added.
3.5. In the PRO plan, the price update frequency depends on the difference between the current price and the target price: every 8 hours when the price is at most 15% above the target price or below it, every 24 hours for a difference of 15–30%, and every 48 hours for a difference of more than 30%.
3.6. If, after the PRO plan ends, the user is tracking more than 3 products, the user must choose which products to delete so that no more than 3 remain. Until then, price updates are paused. The remaining products are tracked under the FREE plan rules.
4. User account
Creating an account requires providing an email address.
The user is obliged to provide truthful data and not share the account with third parties.
The Controller may delete a user account in the event of a breach of these Terms or applicable law.
5. Affiliate links and compensation
Aura Catch uses partner programs and affiliate links, including Amazon Associates, AWIN, and Allegro Partner Program.
The Controller may receive compensation or commission for qualifying purchases made after using an affiliate link available in the Application.
Clicking links may redirect users to external websites.
6. Disclaimer of liability
The Controller exercises due diligence regarding the correctness of data presented in the Application; however:
- does not guarantee price timeliness,
- does not guarantee product availability,
- does not guarantee correctness of descriptions and information from third parties.
Prices presented in Aura Catch may differ from prices currently valid directly in online stores or marketplaces.
The Controller is not liable for:
- pricing errors,
- delayed data updates,
- product unavailability,
- users’ purchasing decisions,
- actions or offers of third parties.
Only information presented directly by the seller at the time of purchase is binding.
7. User responsibility
The user is obliged to use the Application in accordance with applicable law and good practices.
It is prohibited to:
- take actions that may disrupt Application operation,
- attempt unauthorized access to the Controller’s systems,
- use the Application in a way that violates the law.
8. Intellectual property
All rights to the Application, its source code, graphic marks, content, and functionality belong to the Controller or relevant licensors.
Copying, distributing, or using elements of the Application without the Controller’s consent is prohibited.
9. Service availability
The Controller may temporarily limit access to the Application due to technical work, maintenance, or system updates.
The Controller does not guarantee uninterrupted or error-free Application operation.
10. Termination
The user may delete their account and stop using the Application at any time.
The Controller reserves the right to suspend or delete a user account in the event of a breach of these Terms or applicable law.
11. Changes to the Terms
The Controller may amend these Terms in case of:
- legal changes,
- technological changes,
- extension of Application functionality,
- organizational changes.
A new version of the Terms will be published in the Application and on the website.
12. Governing law
The use of the Application is governed by Polish law and applicable European Union law, including GDPR.
